Major Victory To End Water

Company Secrecy About

Pollution and Abstraction

Fish Legal has won a major victory in

its groundbreaking case against

Yorkshire Water Services Ltd and

United Utilities Plc, which was the

culmination of the six year legal

campaign for greater transparency

within the water and sewerage

industry. The implications of this test

case, which has been fought over the

past 6 years, will be felt industry-wide

. It could also affect companies

operating in other privatised industries

which have a similar role managing

resources and services of public interes

t, such as the oil, gas, electricity

providers and the Royal Mail.

The water and sewerage industry,

which causes significant damage to the

environment every year, will now have

to open up what it does to much greater

public scrutiny.

Defra Publishes Ministerial Decision Not to Extend Reservoir Safety Regulations to Cover Small Reservoirs

Members clubs and fishery owners with concerns about whether they would be brought into the new ‘risk based’ approach to assessing reservoir safety in England will be reassured to learn that Defra does not have immediate plans to regulate reservoirs falling between 10,000m3 and 25,000m3.

The government department reports that they do not have the evidence at this time to show that small reservoirs pose sufficient safety risk to justify bringing them into the new regulatory regime established by the Flood and Water Management Act 2010.   Defra will review this decision and consult further after the general election.

Thames Water Fined £220,000 for Polluting Surrey River

The water company was recently prosecuted by the Environment Agency after negligently discharging poorly treated sewage into the river Blackwater. The incident, which took place in 2012, killed fish along nearly a 2 km stretch of this tributary of the river Lodder near Camberley.

Demonstrating a new tougher approach to these types of incidents, the Judge during sentencing said “It is important that the courts send out a clear message to Thames Water and all companies operating in this sector. Regulations are there to protect the environment and that the courts will act firmly where regulations are breached and where the environment is either damaged or put at risk of damage”.

Fish Legal can take action for affected members if they get in touch.
